Cauvery Protests: Tamil Nadu To File Contempt Plea Against Karnataka

Chennai/New Delhi: The row between Karnataka and Tamil Nadu over the sharing of Cauvery water is set to escalate further on Wednesday, with the latter expected to file a contempt petition in the Supreme Court. 

The Jayalalithaa government yesterday decided to file a contempt petition “immediately” after the Karnataka government stopped the release of Cauvery water to Tamil Nadu. The Jayalalithaa government said Karnataka’s action amounted to impeding country’s federal structure. 

“In order to ensure that Tamil Nadu gets its due share of water, the Chief Minister has directed to file a contempt petition against Karnataka government which has unilaterally stopped releasing water, amounting to dishonouring the Supreme Court verdict,” an official release said after a meeting of Chief Minister Jayalalithaa with senior Cabinet colleagues and officials. 

DMK chief M Karunanidhi has, meanwhile, asked the Prime Minister to invoke Article 356 and impose Governor’s rule in the BJP-ruled Karnataka. 

Karnataka had on Monday night stopped release of water from the Krishna Raja Sagar Dam citing low storage in the reservoir, hours after Prime Minister Manmohan Singh made it clear that only the Cauvery River Authority (CRA) can review its order directing the state to release 9,000 cusecs to Tamil Nadu.

The apex court had earlier endorsed the CRA ruling asking the upper riparian state to release 9000 cusecs from September 20-October 15, a decision contested by both states, locked in the decades-long Cauvery dispute. 

Karnataka has been requesting the CRA to stay its 19 September order asking the state to release 9,000 cusecs of water to Tamil Nadu daily till 15 October and keep it in abeyance till the decision was subjected to review. 

The Cauvery Monitoring Committee is expected to meet in Delhi on October 11 during which the reports of the two central study teams that visited both the states are likely to be debated.

Cauvery Protest: Water Stopped For Tamil Nadu

The row over the sharing of Cauvery waters between Karnataka and Tamil Nadu has reached a flash point, with a constitutional crisis unfolding in the state becoming a real possibility.

The state government on Monday evening claimed to have stopped the release of Cauvery water to Tamil Nadu, after the Supreme Court deferred the hearing of the water dispute till the Cauvery River Authority (CRA) takes a call on Karnataka's plea to review its decision of releasing 9,000 cusecs to Tamil Nadu every day till Oct 15.

Chief minister Jagadish Shettar, who was in a combative mood, declared that the water flow to Tamil Nadu would be stopped. "We are committed to protect the interest of our farmers and meet the drinking water needs of Bangalore," said Shettar, expressing his readiness to face any legal eventuality.

According to reports, water release to Tamil Nadu is said to have been stopped later in the evening. Vijay Kumar, executive engineer of the KRS dam in Mandya district, in a statement said the release of Cauvery water to Tamil Nadu had been stopped on the instructions of the state government.

As a constitutional crisis looms large, Shettar expressed hope that the CRA, headed by Prime minister Manmohan Singh, would meet immediately to modify its earlier order. The CRA is expected to meet on Oct 12.

Earlier in the day, the SC took a serious note of the troubled situation in both the states over the water crisis, saying "agitations do not serve any purpose". “All these agitations don’t serve any purpose. Sometimes they may spoil a good case,” a bench of Justices DK Jain and Madan B Lokur remarked.

Analysts feel the court was hinting at the ongoing agitation in Karnataka.

Earlier, Karnataka’s counsel Fali S Nariman urged the court to defer the hearing till Oct 28. Nariman also said that Karnataka would not be able to "release anything more". "It is physically impossible to release. There is already a surplus of 13,000 cusecs," he added.

Counsel also had reservation on the likelihood of the CRA taking any decision on Karnataka’s review petition keeping in view that the top court had passed an injunction order on Sept 28.
In order to make the CRA comfortable in disposing of the review petition, the top court passed a brief order saying, "We clarify that our Sept 28, 2012 order shall not in any way be an impediment in the chairperson (prime minister) taking a decision on the review petition before it (CRA)."

Cauvery Protests: PM To Meet Karnataka Leaders

New Delhi: The Supreme Court on Monday will hear the Karnataka government’s petition seeking reconsideration of its September 28 directive to obey Prime Minister Manmohan Singh-led Cauvery River Authority’s order to release 9,000 cusecs of Cauvery water to Tamil Nadu. 

Intense protests over release of water to Tamil Nadu have been witnessed near Cauvery river basin areas.

The apex court had rapped the state for not obeying the September 19 order of the Prime Minister, who is the chairman of the Cauvery River Authority. 
In the meantime, leaders from Karnataka, including External Affairs Minister SM Krishna, Power Minister Veerappa Moily and BJP leader Ananth Kumar besides Water Resources Minister Pawan Kumar Bansal are meeting the Prime Minister in New Delhi for consultations on the contentious water dispute between Karnataka and Tamil Nadu. 

The consultations come ahead of the Cauvery monitoring committee meeting slated on October 11. The monitoring panel will decide release of water from Karnataka after October 15. 

Karnataka Chief Minister Jagadish Shettar on Sunday defended the state's decision to release Cauvery water to Tamil Nadu, saying it was "unavoidable" in the wake of the recent Supreme Court directive.

Agitation Will Turn Violent Now: Cauvery Protestors

(Century Fox Post): The all-Karnataka bandh to protest the Supreme Court order to Karnataka comply with the Cauvery River Authority’s direction to supply 9,000 cusecs of Cauvery water daily to Tamil Nadu, was total and mostly peaceful in Bangalore. But that’s not the end of the issue. Belligerent organisations who enforced the bandh have now threatened violent agitations if the state government does not stop releasing the water to Tamil Nadu by October 8.

The situation remains grim, and external affairs minister SM Krishna, who is currently in the US on an official visit, has shot off a letter to prime minister Manmohan Singh urging him to seek an interim report from the central team visiting Karnataka and Tamil Nadu to prevent the situation from turning worse and demanded that the supply of water to Tamil Nadu be allowed to be immediately stopped.

“The entire state is waiting with bated breath to get immediate relief as otherwise it will spell disaster for the population in the Cauvery basin,” said Krishna in the letter. Krishna himself hails from Mandya which is in the Cauvery basin.

Vatal Nagraj, who spearheaded the protests on the Saturday bandh under the umbrella organisation Kannada Okkuta, has warned, “We are giving the state government time till October 8; if they do not take the decision to stop releasing water to TN, we will continue our protest...but the protests will not be peaceful like today. They will be different and the entire responsibility of that will be on the Central and state governments.”

He has warned the state government that the organisations would resort to a jail chalo movement and rail roko across the state.
Nagraj met chief minister Jagadish Shettar in the evening and demanded that the supply of water to Tamil Nadu be immediately stopped.

However, Shettar said they would wait until Supreme Court hears the review petition that has been filed before the apex court and which is coming up for hearing on Monday. Nagraj, however, said if water continues to be released beyond Monday, Kannada Okkuta members plan to picket the chief minister’s residence and trigger another protest.

The bandh kicked off with the protesters blocking Hosur Road which runs into Tamil Nadu, about 35 km from the city. Later, Nagraj, also former MLA and leader of Kannada Chaluvali Vatal Paksha, Sa Ra Govind of Dr Rajkumar Fans’ Association and Praveen Shetty of Karnataka Rakshana Vedike of Praveen Shetty led about 200 protesters to try and lay siege to chief minister’s home office, and were taken into preventive custody. The bandh aso saw protesters stopping the metro rail service in the afternoon and 28 BMTC buses damaged in various areas of the city.
